Terms & Conditions
These Terms & Conditions govern your use of our photography services as well as the ordering of prints or products from our website. By booking our services or placing an order, you agree to comply with and be bound by these terms.
- Photography Services
1.1 Booking Confirmation
To confirm your booking for photography services, a signed contract between you (the Client) and the photographer, as well as a non-refundable retainer (of up to 50%) are required. The retainer will be applied to the total cost of your selected package.
1.2 Payment Schedule
The remaining balance is due at least 7 days before the scheduled event or session. Failure to pay the balance by the due date may result in the cancellation of your booking.
1.3 Additional Costs
Any additional costs incurred during or coming up to the event/ session, such as travel fees, permits, extra hours, or additional services requested, will be billed separately and are due upon the receipt of invoice.
1.4 Cancellation and Rescheduling
- 1.4.1 Client Cancellation
If you need to cancel your booking, you must provide written notice. The retainer is non-refundable. Cancellation made less than 72 hours before the event/ session will incur a cancellation fee of up to £60.
- 1.4.2 Rescheduling
You may reschedule your event/ session once, provided you give at least 7 days notice. Rescheduling requests made less than 7 days before the event/ session may incur additional fees.
- 1.4.3 Photographer Cancellation
In the unlikely event that we must cancel, you will be offered a full refund, including the retainer, or the option to reschedule at no additional cost.
1.5 Artist Licence
By booking our services, you agree to the photographer’s artistic style and vision. We reserve the right to edit and deliver only those images that meet our professional standards. No raw or unedited images will be provided.
1.6 Limitations of Liability
- 1.6.1 Damage or Loss
We take the utmost care with your images, but in the event of unforeseen circumstances such as equipment failure, data loss, or other mishaps, our liability is limited to the refund of any and all payments received for the event/ session.
- 1.6.2 Illness or Emergency
In the event that the photographer is injured, becomes too ill, or has an extreme emergency that prevents them from photographing the event/ session, every effort will be made to reschedule the event/ session. If, for whatever reason, this is not possible, responsibility and liability is limited to the rescheduling, or return of all payments received for the event/ session.
1.7 Cooperation
The Client and Photographer agree to cheerful cooperation and communication for the best possible results. The Photographer is not responsible if key individuals fail to appear or cooperate during photography events/ sessions, or if important details are not provided beforehand.
The Photographer will use their professional judgement regarding style, locations, poses, and the number of images taken. This includes, but is not limited to, all artistic decisions made during the session.
1.8 Proofs, Printing, and Retouching
Proof images are individually corrected for colour balance, density, contrast, etc., but no retouching will be applied. All prints ordered or used will receive individual attention, including retouching, enhancement, selective area adjustment, and texture application as deemed necessary by the Photographer.
The Photographer retains total artistic control over the final image, and the Client understands that the Photographer will apply retouching according to their professional judgement.
1.9 Model Release
The Client(s) and Subject(s) hereby grant the Photographer the irrevocable and unrestricted right to use and publish photographs of the Client or in which the Client may be included for the promotion of the Photographer’s business and services. This includes, but is not limited to, editorial, trade, advertising, and any other purpose in any manner and medium.
- Orders, Prints, and Products
2.1 Ordering Prints
Prints and products can be ordered through our website. All orders are subject to these Terms and Conditions, and payments must be completed at the time of ordering.
2.2 Payment for Orders
Payment for prints and products is required in full at the time of purchase. The forms of payment accepted are outlined on our website.
2.3 Order Fulfilment
Orders will be processed once payment is confirmed. Delivery times for prints and products vary depending on the type of product and your location. We will try to provide an estimated delivery time at the time of order.
2.4 Cancellations and Refunds for Orders
- 2.4.1 Order Cancellation
You can request that your order be cancelled within 2 days of placement, provided that production has not yet begun. Cancellations made after production has started or once the order has been shipped are non-refundable.
- 2.4.2 Refunds
Refunds for defective or damaged products will be processed upon receipt of the returned item. Please contact us within 7 days of receiving the product to arrange a return and refund. Refunds will be issued to the original method of payment.
- 2.4.3 Shipping and Handling
Shipping costs are calculated at checkout based on the delivery location and the size of the order. We are not responsible for delays caused by shipping carriers or for any customs duties or taxes applicable to your location.
- Copyright and Usage Rights
3.1 Photographer’s Rights
All photographs taken by Shannon Barr Photography are the intellectual property of the Photographer and are protected by copyright laws. We reserve the right to use the images for promotional purposes, including but not limited to social media, website galleries, and marketing materials.
3.2 Client’s Rights
Upon full payment, you will receive a licence to use the images for personal use. You may print, share, and display the images for personal purposes but may not sell or use them for commercial purposes without the Photographer’s written consent.
3.3 Social Media
When sharing images on social media, please credit Shannon Barr Photography and refrain from altering the images (filters, unnecessary cropping etc.) without prior permission.
- Privacy Policy
Your privacy is important to us. We will not share your personal information with third parties without your consent, except as necessary to fulfil your booking or order, or as required by law.
- Governing Law
These Terms and Conditions are governed by the laws of Northern Ireland. Any disputes arising from these terms will be resolved in the courts of Northern Ireland.
- Agreement
By booking our services or placing an order, you acknowledge that you have read, understood, and agree to these Terms and Conditions. If you have any questions or concerns, please contact us before booking or ordering.
